FEDERAL CLEAN WATER ACT (CWA): Arizona Department of Environmental Quality Webinar | 2023 Triennial Review Kickoff | Aug. 2, 2023, 2 p.m

The Arizona Department of Environmental Quality (ADEQ) has received an exemption from the Rulemaking Moratorium (A.R.S. § 41-1039) to update water quality standards to meet this CWA requirement.

The federal Clean Water Act (CWA) requires that at least every three years each state review and, if necessary, update its water quality standards for surface waters. This process is called a Triennial Review (TR). The TR process helps ensure that water quality standards are up-to-date and protective of Arizona’s surface waters. It also provides opportunities for public input and involvement in the water quality management process. 

The Arizona Department of Environmental Quality (ADEQ) has received an exemption from the Rulemaking Moratorium (A.R.S. § 41-1039) to update water quality standards to meet this CWA requirement. The requested rulemaking will modify A.C.C. Title 18, Chapter 11, Article 1, to accomplish the following goals:

  1. Update the surface water quality standards used by ADEQ to protect human health to the levels required by the U.S. Environmental Protection Agency; and
  2. Modify the designated uses of some Waters of the United States (WOTUS) protected by the CWA to reflect how those WOTUS are currently used.

A Notice of Docket Opening for Arizona Administrative Code Title 18, Chapter 11, Article 1, was filed with the Secretary of State’s Office and is slated for publication on July 14, 2023. The docket will remain open for one year unless extended by ADEQ.
