Ukrainian MP Yaroslav Zheleznyak has claimed that his country has been given a “yellow card” for corruption by the US and must take action to avoid receiving a second one.
Writing on his Telegram channel on Monday, Zheleznyak acknowledged that Ukraine has serious corruption problems and said it must now be “holier than the Pope” if it wants to receive continued US assistance. 
The MP further argued that Ukraine has become a “hostage” of US domestic politics. However, he insisted that Kiev must still press Washington to set aside funding for it in the government budget, which is set to be agreed upon within the next six weeks as part of the deal reached by US lawmakers on Saturday night.  

“The main complaint against us is corruption,” the Ukrainian MP pointed out. “We must spend these 45 days without A SINGLE major corruption scandal. As far as I know, this is exactly what our representatives were told when they visited [the US]. No nonsense or pretentiousness.” 

  • Zheleznyak stated that Ukrainian authorities must demonstrate their resolve in fighting corruption and should crack down on the biggest offenders, regardless of how “important” they may be to the president. 
  • Without providing names, Zheleznyak claimed there is a specific list of people who have become symbols of corruption in Ukraine and have been “cheating” international partners.  
“Either they go to hell, or we get assistance. The choice is obvious,” the MP wrote. He added that the international community pays particular attention to state-owned enterprises, reconstruction, military procurement, customs, and law enforcement in Ukraine. 
The leading figures in all these areas are “stupid corruptors” and should immediately be removed to preempt potential corruption scandals, Zheleznyak claimed.  

Elsewhere, fellow Ukrainian MP Aleksey Goncharenko has suggested that Kiev needs to be more proactive in attempting to secure funds from Washington. According to the lawmaker, Ukraine should dispatch permanent delegations to the US Congress, send MPs to every US state to “convince” Americans of the need to support Ukraine, and even pledge to join any future military campaigns launched by Washington.

The American government is more concerned about the level of corruption in Ukraine than it publicly admits, according to a sensitive document seen by Politico. Per the document, US policymakers fear that Western nations would withdraw their support for Kiev if the problem is not solved
Quietly published by the US State Department in August, the ‘Integrated Country Strategy’ for Ukraine sets out Washington’s long-term goals in the country. A public version makes several references to corruption, recommending that Kiev “slay the corruption dragon once and for all,” in order to speed up Ukraine’s accession to NATO and make the country more attractive for Western investors when the conflict eventually ends.
A longer version of the document went unpublished, however, Politico reported on Monday. According to the report, the “sensitive but not classified” version runs three times as long, and is more blunt in its assessment of the situation in Ukraine.
“Perceptions of high-level corruption” could “undermine the Ukrainian public’s and foreign leaders’ confidence in the war-time government,” the extended version reportedly states.

Ukrainian Lawmakers Approve Amended Bill On Asset Declarations

Ukrainian lawmaker Yaroslav Zheleznyak wrote on Telegram on September 20 that parliament passed an amended bill on asset declarations after a previous text passed by the Verkhovna Rada in early September was vetoed by President Volodymyr Zelenskiy. 
  • The veto came amid a struggle by the Ukrainian government to clamp down on corruption and assure allies that it’s committed to fighting graft. 
  • The original approved bill included a loophole that would keep the disclosures closed to the public for one year. 
  • Zelenskiy said such declarations should be public “immediately, not in a year.”

The Committee on Finance, Taxation and Customs Policy discussed the feasibility of criminalizing of smuggling

The Committee on Finance, Taxation and Customs Policy held a round table conference on "Criminalization of Commodity Smuggling" with the participation of MPs, representatives of central authorities, business associations, relevant associations and scientists.
Opening the meeting, First Deputy Chairman of the Committee on Finance, Taxation and Customs Policy Yaroslav Zheleznyak said that the Committee on Law Enforcement had already considered the draft Law No. 5420 "On Amendments to the Criminal Code of Ukraine and the Criminal Procedure Code of Ukraine on criminalization of smuggling of goods and of excisable goods, as well as inaccurate declaration of goods" and decided to recommend to the Verkhovna Rada to adopt it as a basis based on the results of the consideration in the first reading. At the same time, according to him, there are a number of remarks to this bill, both by business representatives and MPs, so they decided to hold a round table to discuss the bill.
Among the remarks made by business associations and experts, he also named:
- prosecution depending on the amount of damage to the budget, not on the value of goods;
- the need to raise the limit of criminal prosecution for smuggling both excisable and non-excisable goods;
- establishment of criminal liability for acts committed by prior conspiracy by an official of the customs authority, which may lead to bureaucratization of the customs service;
- criminalization of smuggling of only excisable goods is supported, while the question of inclusion in this list of vehicles remains;
- the size of sanctions for criminalized acts;
- the need to add intent to the mandatory feature of the offense.
In his speech, the head of the State Fiscal Service Vadym Melnyk called the bill important and expedient, as it will allow customs authorities to document crimes, as well as to join operational and investigative measures and urgent investigative actions. In addition, in his opinion, the introduction of criminal liability for smuggling can serve as a deterrent for those who want to commit such a crime. Vadym Melnyk noted that the bill is beneficial for law enforcement agencies, as the phenomenon of smuggling has become significant, and the project provides for the qualification of crimes as serious and especially serious.
The meeting was also addressed by business representatives, who supported the criminalization of smuggling of only excisable goods and raising the threshold for such liability.
The provision on establishing criminal liability for acts committed by a conspiracy officer of a customs authority raised the most questions. According to business associations, this rule will encourage customs services to look for errors in declarations to avoid accusations of facilitating smuggling.
The participants of the meeting noted that the damage caused to business will significantly exceed the positive effect of the implementation of the bill. Therefore, it needs significant refinement.
Speakers also supported the need to use economic leverage to reduce the smuggling of goods, in particular, to eliminate the demand for unregistered goods. . .
