The $22 Million Navajo Nation Housing Lawsuit [1]
In February 2026, Indigenous Design Studio + Architecture (IDS+A) filed a lawsuit against ZenniHome in the Maricopa County Superior Court (Indigenous Design Studio + Architecture, LLC v. ZenniHome, LLC, Case No. CV2026-005847). [1, 2]
  • The Project Breach: IDS+A subcontracted ZenniHome to construct, deliver, and install 160 culturally designed, affordable prefab homes for the Navajo Nation using federal pandemic relief (ARPA) funds. ZenniHome shut down its operations after constructing only 18 partially finished units. [1, 2, 3, 4]
  • Core Allegations: The verified complaint alleges fraud, waste, breach of contract, unjust enrichment, and the misuse or squandering of $22 million in federal public funds. Plaintiffs claim Worsley refused to provide financial records tracing where the money went. [1, 2, 3, 4]

Whoever said Mesa is boring was trying to sell you an urban myth.
Perhaps politics used to be boring, but it sure ain't no more. It's a potentially combustible combination producing all kinds of reactions and consequences - some that blow-up big time, some that fizzle-out and fade-away, and some that might cause people to pay attention.
Let's focus on two: CD 18 in Pennsylvania and CD8 here in Arizona

"The Democrat and Republican in a special House election in the heart of Pennsylvania’s Trump country were divided by a few hundred votes in a race that was too close to call early Wednesday — an ominous sign for Republicans in a district that Donald J. In 2016, Mr. Trump won the district by double digits, but the race between Conor Lamb, a moderate Democrat, and Rick Saccone, a Republican, had become unexpectedly competitive.
Whoever wins will have to decide soon which district to run in this year. The State Supreme Court threw out Pennsylvania’s current congressional map and recently issued a new map with redrawn boundaries. Ft. McMansion on Presidio Circle in The Groves in northeast Mesa, Worsley managed to amass a personal fortune. . . once in office he became a proponent of personal corporate welfare for himself and his friends.

Worsley, a Republican who founded the advertising magazine SkyMall, said he has 10-year agreements to sell power to Arizona Public Service and Salt River Project.
That revenue stream will help the plants turn a profit.

STATE CAPITOLIts sponsor saying renewable energy is the best source of economic development in Arizona, a bill providing tax incentives for renewable energy facilities was unanimously adopted Wednesday by the Senate Commerce, Energy & Military Committee on a 5-0 vote.
SB 1484 establishes an individual and corporate income tax credit for investments of at least $300 million in a three-year period in new renewable energy facilities that produce energy for self-consumption using renewable energy resources if the power would be used primarily for manufacturing.

“These industries are most potent” in driving state’s economy,” said the bill’s sponsor, Sen. Bob Worsley, R-Mesa. “This is a way to attract a different breed of clientele.”

Whole Lotta Heavy-Lifting To Dig Into Shovel-Ready Stories

Let's start off this post with a Dummy Hypothesis - we all know those great "Dummy Books": Windows for Dummies or Microsoft for Dummies or Accounting Principles for Dummies are good examples. Some mainstream media and independent news sources have a lot of resources (staff, equipment, tools), your MesaZona blogger uses all of his senses + a sixth-sense called "A Nose For The News"
. . . when something stinks, it stinks. Period. The same thing applies to other senses: what we see and what we hear if we keep our eyes and if we keep our ears open and Stay Woke.
Then again what we hear is another human sense that reacts to a whole spectrum of communication wave-lengths that get filtered through our perceptions of what's real or not, and what's believable or not. We may also all be reverting to our primitive hominoid Neanderthal Tribal Instincts self-segregating ourselves in cocoons of comfort-zones both mentally and physically where we live.
Here is Mesa that sets the stage for How Power Plays-Out.

Fortunately at times it's very visible - you can see it and hear it if you pay attention. One of the recently broadcast episodes unfolded here on February 26, 2018 with a special appearance in front of the public at a Mesa City Council Study Session by Mega-Millionaire Bob Worsley taking on two roles at the same time - one as an Arizona State Senator holding public office and one a private real estate speculator. 
Here in Arizona - and almost anywhere else - that's a combustible mixture that's blown up more than a few times when real estate interests add fuel to the fire and it starts to stink. Let's just say they're Opportunity Zones or OZ for short

In the 20th Century two outstanding examples pop up: Charles Keating/The Savings-and-Loan Crisis/The Keating 5, The Re-Call of Governor Meacham).
Let's flash-back to 2016 when Mesa Mayor John Giles appeared in his State-of-the-City Speech - it's the same plot line as the drama on 26 February where the devil's still in the details about ASU.
This time around there are more twists and details we need dig deeper to uncover the sources of what stinks.

Thanks to digging by The Arizona Daily Independent we can see what's gone on behind-the-scenes after Mesa voters rejected the radical transformation of downtown Mesa into a "satellite campus" for ASU.
As things turned out it was beyond reality - projecting half-baked Pie-In-The-Sky proposals on promising to deliver anything concrete based on transient students to ride the boom in student housing that devoured downtown Tempe.
The central business district on Main Street has been left as 'The Old Donut-Hole' since the outflux to 1970's suburbia.
Now said Bob Worsley "the time is ripe and the moment has arrived" to revive the moribund CBD that's only been on flat line life-support for 12 years from the Mesa Arts Center opening in 2005 and the arrival on Main Street through the CBD by Valley Metro Light Rail Service in August 2015. Now another '15-year moment' has arrived for Investors - 'angel investors' or otherwise - to buy into The New Zion purchasing not just one property at a one but swooping in to grab up and assemble commercial properties all at once last year . . . TRUTH OUT: “The reason why we were attracted to join was that our partner Bob Worsley had quietly organized the ability to purchase nine buildings at once so we could come in at scale and buy up about 30% of the square footage in Downtown Mesa in one single transaction,” he continues. “That allowed us to renovate all those buildings to a higher standard, which we felt would then lift the standards for everybody else.”

Just coincidentally - and probably not - in the same month and just  weeks after  facing public anger, conservative Mesa Mormon Millionaire Republican AZ State Senator Bob Worsley was forced to reveal himself as the grand wizard of a rampant real estate speculation scheme who just managed somehow to snap up ten commercial properties on Main Street in a package-deal with a Caliber Private Wealth Fund LLP II.

The senator’s appearance surprised many Mesa residents who had never before seen their representative show any interest in the City’s business

It is not the city’s business however, that prompted the appearance by the wealthy developer/senator.

In May 2016, Mesa Mayor John Giles announced plans to build a new campus for Arizona State University (ASU) featuring film, media, gaming, virtual reality programs. In November 2016, Mesa voters rejected a sales tax that would have funded the project and public safety.

According to Mesa City Councilman Kevin Thompson, constituents “time and time again” told him that they would support the increase for public safety, but could not support using public money to build ASU a . . ."

On the same day as the Council meeting, Caliber Wealth Development Company, “a real estate investment, development and management firm, and project partner, Habitat Metro,” announced the purchase of eight downtown buildings for $7.5 million on Main Street. In a press release, Caliber claimed that “the nearly 100,000 square-feet of historic urban buildings are important project components to the economic strengthening and downtown transformation efforts of Arizona’s third largest city.”

How Chris Loeffler re-shaped Downtown Mesa - AZ Big Media

'It takes guts to be an entrepreneur even during the best of times. Chris Loeffler, CEO and co-founder of Caliber, showed he’s got more than his fair share of chutzpah when he told his parents that he planned to quit his job to start a real estate company — in 2009. At the time, he was working as a senior associate in the audit and assurance practice for PwC in Phoenix, but he had always liked the idea of becoming an investor and saw an opportunity to pursue that path.

More than a decade later, Caliber is a thriving business helping shape the ever-expanding Valley. One of the places Caliber has its fingerprints all over is Downtown Mesa. Loeffler says the city had a vision of a vibrant downtown area so Mesa residents wouldn’t have to go to Scottsdale, Tempe or Phoenix for those types of amenities and experiences. Prior to Caliber’s involvement, the buildings in Downtown Mesa had different owners, which meant that they were poaching tenants from one another and pursuing their own individual goals. . .

Since the buildings were in an opportunity zone, it gave Caliber more flexibility to spend years turning the downtown area around instead of being bound to a tight timetable, which Loeffler says was necessary because the buildings were vacant for a while as Caliber figured out the right mix of tenants to create a unique identity and not simply be a carbon copy of what other cities had done.


Loeffler adds that City of Mesa took a novel approach to revitalizing its downtown. Typically, someone like Loeffler will come in, buy some buildings and put together a plan to change the area. Afterwards, the city will step in to invest in infrastructure around the area.

 


“Instead, the City of Mesa put $100 million into their performing arts center. They transformed Pioneer Park. They brought in [Arizona State University], supported light rail, did all the sidewalks, curb cuts, streetlights — everything was done,” Loeffler says. “That opened the door for us to think about Mesa in ways we probably wouldn’t have, had we not seen that.”

Looking forward, Loeffler notes that there is turbulence in the market, but Arizona will manage it well.

“We have some market forces that are creating a floor for how far things will come down,” he concludes. “With interest rates going up, there should be an expectation that property values are going down. But there’s a floor because there’s so much success going on with attracting businesses — Taiwan Semiconductor Manufacturing Company, the Intel expansion, Virgin Galactic — and that’s attracting people from all over the country. If you’re trying to pick a place to invest, I would want to own as much Arizona real estate as I could.”

Caliber’s $7.625 million purchase consists of eight historic buildings along Main Street between Country Club Drive and Center Street.
Investment in, and re-development plans for, the nearly 100,000 square feet of historic urban buildings are important project components to the economic strengthening and downtown transformation efforts of Arizona’s third largest city.
Caliber Development, a subsidiary of Caliber – The Wealth Development Company, will serve as design-general contractor.
Initial concepts for revitalization include, among others, a rooftop restaurant on The Newberry building. According to Roy Bade, Executive Vice President of Commercial Acquisitions and Development, “Caliber is proud to play a part in this important project for the city of Mesa. We’re currently working on restoration plans with prospective new tenants to renew the energy and excitement of these underutilized historic buildings.”

Currently, Schrader says there isn’t a whole lot to do in Downtown Mesa. Caliber wants to add options to the area through its redeveloped properties and create a setting where visitors will want to spend an entire day in Downtown Mesa.
“I hope people really fall in love with the community again,” Schrader says. “Mesa has an opportunity to really create a good family setting, somewhere where people will want to raise their kids, will want to spend time and not be so transient anymore.”

Giles says it’s great to see private investment from Caliber that will help further transform the Downtown Mesa area, making it more attractive for future employers and private investment.
Here's the Punchine: Caliber’s developments could also bolster Mesa’s efforts of bringing ASU into Downtown Mesa as well, Giles says.
He says economic developers have to make areas around universities attractive for students, and public investment on things like the light rail and the Mesa Arts Center are one part of that.
“We also need the business community infrastructure to create an environment that’s welcoming and attractive for people,” Giles says.
Caliber will create these attractive environments as it brings the historic vibe back to Downtown Mesa. All eight of the buildings Caliber purchased were built between 1910 and 1954.

Bade says Caliber is currently working on getting six to eight tenants to move into the buildings, and then another three to six months would be needed for tenant improvements.
“Our goal here is for people to want to stay in downtown,” Bade says. “They don’t want to come here for breakfast or lunch. They want to stay here, live here, make it their home in downtown, versus a place to visit.”

Quirky LDS Conservatives > Mixing-Up Politics + Real Estate?

Probably any image could have been selected to start off first for this post, but this for some unexplained reason caught the attention of your MesaZona blogger.
Notice who endorses who in this close contest for Arizona State Senate, District 25 Republican Primary in 2014.
Bob Worsley beat Ralph Heap by 1,646 votes out of 29,300 cast and went on to win the General Election by 70.5%.
Two years before, Worsley won election in the 2012 election for Arizona State Senate District 25 defeating former Arizona Senate President Russell Pearce in the Republican primary by 3,666 votes out of 30,734, winning in the general election with 66.6% of votes.
In the general election held on November 8, 2016, incumbent Bob Worsley ran unopposed in the Arizona State Senate District 25 general election winning with 100% of 69,914 votes to bolster the LDS control of the AZ State Legislature.
Apparently, he's now answering "a higher calling" to continue the mission to expand the legacy of The Mormon Pioneers for a New Zion - complete with plans for a Mesa version of Temple Square in Salt Lake City and a choir hall of sorts.
Still working on ways to finance that, the hive in Mesa politics is buzzing all the way from elected public office in the Arizona State Capitol to Mesa City Hall in fields of schemes for real estate development right here in downtown, where politician State Senator Bob Worsley, who first approached the city as un-named "private developer" and got the Mesa City Council to approve a Memorandum of Understanding, registering a new corporate LLC just six days before, for a proposed project atop a parking lot after quietly buying 29-35 W Main Street [and at least 8 other properties] in undisclosed deals to control the downtown real estate market when sellers agreed to a price of around $100/square feet. The new LLC named MACDevco, together with an associated entity called "Ranches of America' lists their 5,300+ sq ft home in the citrus groves on N Val Vista Drive here in northeast Mesa as the business address.
This image to the right of the proposed project, located behind public charter school Heritage Academy [in the dark spot at the center], across Drew Street, might be built on top of a 103-space parking lot with a footprint of less than an acre of land.
It is currently being used as free parking for customers and employees of six businesses fronting on the south side of Main Street between Drew Street and MacDonald.
Located within 300 feet of a school, it could be problematical to apply for a liquor license on the premises.
Plans also call for 'a food hall', a hotel with 75 rooms, and 75 "above-market rate" apartments . . .

Navajo Nation announces $50M contract with Mesa-based ZenniHome to help meet housing demand

Sounds of heavy machinery inside the bustling 40,000-square-foot ZenniHome facility in Page suddenly fell silent once President Buu Nygren of the Navajo Nation was introduced. Last Friday, the Navajo Nation announced a $50 million contract to construct 200 free homes for Navajos in dire need.
Nygren made a grand entrance, shaking the hands of some 135 Navajo employees, who once worked at the largest coal plant west of the Mississippi River — the Navajo Generating Station — before it closed in 2019.
As many as 1,000 jobs were lost. That hurt the Navajo Nation, which was already facing an acute unemployment rate that sits at 56% today. During his inaugural State of the Navajo Nation address in January, Nygren expressed that “our goal for ZenniHome is to restore the jobs lost from the NGS closure.”
Now, some of those former NGS employees are finally going back to work, but this time for ZenniHome, and ready to build badly needed homes with federal funds from the American Rescue Plan.

Nygren even acknowledged that ZenniHome took a gamble by locating the plant in Page.
“I want to say thank you. Even though you’ve been set up here for over a year, you haven’t got one single contract with the Navajo Nation,” said Nygren. “And that’s what I call heart and dedication to serve our people.”

“We have to retool these fantastic workers into another trade,” said former Republican state Sen. Bob Worsley, the founder of ZenniHome, adding that this site is primed to become “a great economic center for the Southwest, right here on the Navajo Nation.”

“We’re happy to see this 1,000 acres become very clean, environmentally friendly, consistent with Mother Earth, because Mother Earth is our home, right, in the Navajo tradition, Worsley elaborated. “She’s our home, and we're going to build homes from this location that used to be a coal plant.”

Recovered materials were shipped off to Nucor Steel in Plymouth, Utah 
Nucor is the largest steel producer in the United States and the largest recycler of scrap in North America.[1] Nucor is the 16th-largest steel producer in the world.[2] 
Along with Commercial Metals Company, it is one of two primary suppliers of rebar used to reinforce concrete in buildings, bridges, roads, and infrastructure in the U.S.

That process is to practically and aesthetically design modular homes with Indigenous input from the foundation up. Begay began her architectural company in an attempt to connect culture, language and tradition through design, and to collaborate creatively.
“We don't do that now,” admitted Begay. “We see a lot of architects coming in, giving us designs, the way that we should live, the way that we should live with our HUD homes.”
One of those uniquely Navajo-inspired features is ensuring these homes are compatible with wood and pellet stoves. The Environmental Protection Agency estimates that nearly two-thirds of reservation homes are heated by them.
“We want to make sure that if that happens, these units are all code to code,” Begay added. “You can tie in your wood stove as well as pellet stoves.”
  • All of them are ADA compliant, able to connect to solar panels and possess Wi-Fi compatibility. 
  • Space and storage are other concerns Begay cited, since widespread overcrowding in existing smaller, multi-generational homes is another problem.
Construction, coupled with shipping and freight costs, have also spiked on the reservation.
Despite the financial obstacles, Begay says Navajos, like herself, still deserve “homes that are durable, affordable, sustainable, and that represent our culture and our identity.”

". . .Crews for Caliber, which owns 10 properties on Main Street, have finished demolishing a bank building at 29 Main St. and filled in its basement and former vault with “engineered” dirt fill.
Work will now begin on a ground-floor base, estimated to take four months, that will eventually serve as foundation for 90 factory-built studio and two-bedroom units locked together to form the midrise tower.The ZenCity units are made by startup modular home maker ZenniHomes, founded by former Arizona Senator and Sky Mall founder Bob Worsley.

ZenCity will be ZenniHome’s first mid-rise project, made up of 90 units across two 5-story towers. The units come in 320-square foot studio and 640-square foot two bed configurations, both featuring full kitchens, automated furniture, and floor-to-ceiling glass to take advantage of the panoramic views of downtown Mesa. The residential towers will be stacked on top of ground floor commercial space that also has access to a commercial basement.

‘ZenCity’ could bring unique structure to downtown

"If all goes according to plan, downtown Mesa will be the state’s first site of an apartment complex created from Arizona-made two-bedroom and studio homes stacked and connected together like LEGOs to form two five-story midrise towers on Main Street.


ZenniHomes, founded by businessman and former state lawmaker Bob Worsley in 2019, has signed a deal with an owner of a historic property on Main Street to create a 90-unit apartment complex on top of existing basement and ground level commercial spaces.

The modular homes would be sent to Mesa from ZenniHomes’ new factory in Page in Northern Arizona at the site of the former coal-fired Navajo Generating Station power plant, which closed in 2019.

✓ ZenniHomes’ residential units are 320 square feet for the studios and 640 for the 2-bedroom and are built to the dimensions of shipping containers to reduce the costs of construction and transport.

The company says the individual units are ideal for first-time homebuyers, retirees, rentals and resort living.

But it is also a “developer solution for affordable housing” because the apartments can be stacked together for up to five stories and 100 units. 

✓ In June, Mesa’s Board of Appeals approved several form-based code variances for the company’s “ZenCity” plan in Mesa that it said were needed to construct the project on “an existing site with its unique and innovative construction techniques while maintaining the ground floor and basement commercial uses,” documents submitted to the city stated.


 

Recently, the property owner announced that a deal has been signed with ZenniHomes to install the units and estimated the project would be completed next year.

✓ ZenniHomes advertises its product as good for the earth and the economy while promising to deliver “luxury, style and sophistication.”

The units, listed currently for $75,000 and $100,000, respectively, might also help housing-starved communities all over the country add workforce residential units at lower costs than conventional apartments.

A representative for ZenniHomes told the board of appeals that downtown Mesa is currently experiencing high demand for new residential units from “urban professionals,” students attending classes downtown and workers in downtown’s restaurants and boutiques.

By manufacturing the modular homes in Page, Worsley said in the release,  ZenniHomes would be “reshoring manufacturing from China to an opportunity zone investment at the Navajo Generating Station.”

Before it closed, the Page coal plant employed over 500 workers, including many people from the nearby Navajo Nation, so the loss of jobs was an economic blow to the region.

 If ZenniHomes ramps up production, it could help replace some of the industrial jobs lost after the closure.

✓✓ The investments in Page and downtown Mesa also has tax benefits for investors, as the two locations are within designated opportunity zones that allow investors to delay or eliminate federal capital gains taxes on income they put into opportunity zone projects.

In 2017, Caliber began betting big on the revitalization of downtown Mesa, eventually purchasing 10 buildings totaling 160,000 square feet.

Brian Snider, senior vice president of real estate at Caliber, said the firm believed downtown Mesa “had the potential for pretty dynamic change.”

“I think it’s still emerging, but I think all the pieces are going to come together,” Snider said of downtown. “When we get into the new year, we get more into the potential of the university.”

A key element of downtown’s transformation will be enticing the influx of students and professionals in downtown to stay after work hours and explore the burgeoning craft brew and restaurant scene.

Other Caliber projects recently opened or announced will contribute to this nightlife.

Earlier this year, Caliber announced downtown leases with Level 1 Arcade Bar, a venue featuring fully restored arcade and pinball machines along with a full menu and bar, and Copper City Spirits, an Arizona distillery that uses local ingredients.

Caliber announced last week that it has signed a lease with Sonoran Rows, a Craft Malthouse, which will be located at 18 W. Main. Set to open in the second half of 2023, Sonoran Rows will serve as a working malthouse along with a restaurant and bar operating in more than 15,000 square feet along with 3,000 square feet of patio space. 

Malting is the process of soaking and germinating grains to release enzymes that enhance the grain for brewing and baking.

In a release, Caliber said the Sonoran Rows plans to malt 25 tons of Arizona grown barley and other grains in the traditional style of floor malting each week. The malted grains can be used by local breweries, distilleries and restaurants.

> Snider suspects Sonoran Rows will be working with other players in Mesa’s craft beer scene. Craft breweries “are a fairly tight network, and they see a lot of synergy being together and seeing that brewmaster atmosphere,” he said.

Caliber also is working with the Salt River Pima-Maricopa Indian Community to build an entertainment-residential district on 10 acres of the Talking Stick Resort between Mesa and Scottsdale off the Loop 101.


✓ Caliber has found users for many of the historic buildings it purchased in 2017, but Snider said it hasn’t been easy getting them renovated.

“These have been challenging buildings. They’re old,” he said, but “we’re largely on top of that and moving forward with getting these tenants in.”
