2022 Clean Water Act Assessment Public Comment & Appeal Updates

This is to notify you of changes made to the 2022 Clean Water Act Assessment as a result of public comments and the appeals process.

Public comment updates:

  • Skunk Creek (15070102-003) and New River (15070102-002) were removed from the impaired waters list. In their public comments, the City of Glendale demonstrated that sampling locations were not in Skunk Creek or New River but were adjacent to the washes.  
  • Critical conditions in Appendix B for Davidson Canyon (15050302-153A) have been updated.

Appeal updates:

  • Indian Bend Wash (15060106B-179) was removed from the impaired waters list. The City of Phoenix demonstrated that the sampling location was not in Indian Bend Wash but was adjacent to the wash in comments submitted after the close of the public comment period.

The draft assessment was sent to EPA on April 5, 2022. The EPA can approve or disapprove ADEQ's decisions.
