Notification of Federal Stay | Municipal Solid Waste Landfill Rules

Dear Interested Party,

On May 31, 2017, the Environmental Protection Agency administratively stayed the federal rules requiring new emission guidelines and New Source Performance Standards for municipal solid waste landfills in their entirety for 90 days. These federal rules were previously promulgated at 40 CFR Part 60, Subpart Cf and 40 CFR Part 60, Subpart XXX. Before the federal stay, the Arizona Department of Environmental Quality (ADEQ) amended R18-2-731 and R18-2-901 to incorporate by reference subparts Cf and XXX. ADEQ held a public comment period and hearing on these amendments and a proposed Clean Air Act Section 111(d) state plan on May 15, 2017. ADEQ appreciates the input received from stakeholders. Due to the federal stay, ADEQ has suspended work on the rule amendments and the 111(d) plan until further notice.
